Outline (in English)
[Course Outline] The aim of this course is to provide an opportunity to consider the state of criminal investigation in the information society through an overview of the debate on the regulation of new investigative techniques that have arisen with the development of information technology.
[Learning Objectives] The goal of this course is to understand what kind of solutions are being attempted to solve various problems related to criminal investigations that have arisen as a result of the advanced development of information technology.
[Learning Activities Outside of Classroom] Before/after each class, students are expected to spend 2 hours to prepare for/review the lesson.
[Grading Criteria / Policy] The overall grade will be based on the term-end examination (100%).

授業の概要と目的（何を学ぶか）Outline and objectives
情報技術の発展は，新たな犯罪捜査手法を生み出す。これらの新たな捜査手法は，複雑化・巧妙化を続ける犯罪行為に関する情報収集手段として極めて有用である。他方で，これらの捜査手法については，それが対象者の「プライバシー」等を制約する側面を有することも多いこと，及び現行刑訴法が主として伝統的な捜査手法を念頭に置いた規定を有していることから，その許容性・許容要件が活発に議論されている。
本講義では，情報技術の発展に伴って生じた新たな捜査手法に対する法的規律についての議論の概況を把握することを通じて，情報社会における犯罪捜査のあり方を考える端緒を提供することを目的とする。
到達目標Goal
情報技術の発展に伴って生じた犯罪捜査に関する種々の問題について，立法・判例・学説上どのような解決の試みが行われているのかを理解する。

刑事訴訟法を学んだことがない学生であっても内容を理解できるよう，捜査法に関する前提知識からレクチャーする。
