Course outline
Regarding legal documents created from the standpoint of a lawyer, by having them actually draft a legal document within the lecture time on the premise of a simple case, confirm the practical ability of legal thinking required in practice, and look back on the theory from there.
The purpose is to "practice and look back on theory".
Learning Objectives
Apply the knowledge and understanding of the law that you have learned so far to specific cases so that you can draft the basic contents of typical legal documents.
At that time, while being aware of the so-called requirement facts, we will be able to make drafts that are not limited to that, but are also aware of legal requirements and legal effects.
Through the above, you will acquire the ability to apply fact-based laws and be able to think practically.
Learning activities outside of classroom
As a pre-class preparation for drafting, read the relevant part of the basic document of the Procedure Law concerning the document. However, before drafting the content certification mail and the draft of the notarial act, search the text to find out where the content certification mail is legally a problem and when the notarial act is legally a problem. Or search from the index of the basic book to check.
After making the draft, before the commentary class, how to check the legal requirements and legal effects of the substantive law part that became a problem in the draft in the basic book, and then compare it with the problematic case. I will reconsider whether the fitting was possible.
After the commentary lesson, while referring to the resume, read the basic book of the relevant part again and review how the lesson content is related to the content of the basic book.
Through the above, we will confirm the importance of legal homes and legal effects at the basic book level.
The standard preparatory study and review time for this class is 2 hours each.
Grading Criteria /Policy
Evaluate at normal points.
At that time, we will refer to 6 in-class drafts and questions and answers in class, and evaluate the drafts at a rate of 90% and the questions and answers at a rate of 10%.
Each draft is scored by A (excellent), B (good), C (possible), D (impossible).
If you are absent from class on the drafting day, you will be given a D rating.

授業の概要と目的（何を学ぶか）Outline and objectives
弁護士の立場から作成する法律文書について，簡単な事例を前提に，講義時間内に実際に起案してもらうことにより，実務において必要とされる法的思考の実践能力を確かめ、そこから理論を振り返ります。
「実践と、そから理論を振り返る」ことが目的です。
到達目標Goal
これまでに学んだ法律の知識や理解を具体的事案に当てはめ，典型的な法律文書について，基礎的な内容の起案ができるようにします。
その際，いわゆる要件事実を意識しつつも，それのみにとらわれず，法律要件や法律効果を意識した起案ができるようにします。
以上を通じて，事実を前提とした法の当てはめの能力を身につけ，実践的な法的思考ができるようにします。

簡単なモデル事案を前提に，講義時間内に，テスト形式で，訴状・答弁書等の法律文書を起案してもらい（その際、原則として何を考えて起案をしたのか、起案の理由も記載してもらいます。），翌週にその起案内容をについて講義することを基本とします。
起案時は，参考文献等の持ち込みは自由とする予定です。
講義時には，質問もしますので，指名されなくても学生諸君から積極的に回答を述べていただきたいと思います。
また，モデル事案の内容に合わせて，不動産の登記簿謄本等，実務で利用される基礎資料をお配りし，その資料の見方，使い方等の簡単な解説もします。

法律文書の起案について簡単な全般的解説をし，その上で訴状の起案等をしてもらいます。
第2回[対面/face to face]：上記の解説
起案した訴状に関して，実体法・手続法を含めた解説等をします。
第3回[対面/face to face]：答弁書の起案
答弁書の起案等をしてもらいます。事案としては，会社法がらみの事案を予定しています。
第4回[対面/face to face]：上記の解説
起案した答弁書に関する実体法・手続き法の解説等をします。
第5回[対面/face to face]：民事保全の概括的な解説
翌週に、民事保全の起案をしてもらいますが，その前に，１回分の講義時間を使って，民事保全について，必要な範囲で概括的な解説を行います。
第6回[対面/face to face]：民事保全の起案
民事保全申立書の起案等をしてもらいます。
第7回[対面/face to face]：上記の解説
起案した民事保全申立書の実体法の解説等をします。必要に応じて民事保全法についても解説します。
第8回[対面/face to face]：内容証明郵便の起案
内容証明郵便の起案等をしてもらいます。
第9回[対面/face to face]：上記の解説
起案した内容証明郵便に関する実体法等の解説等をします。
第10回[対面/face to face]：公正証書案の起案
公正証書の案についての起案等をしてもらいます。
第11回[対面/face to face]：上記の解説
起案した公正証書の案に関する実体法及び公正証書についての解説等をします。
第12回[対面/face to face]：和解条項案の起案
和解条項の案についての起案等をしてもらいます。事案としては、会社法がらみの事案を予定しています。

起案した和解条項の案に関する実体法・手続き法についての解説等をします。
第14回[対面/face to face]：契約書についての解説
売買契約書を例にして，契約書についての考え方等の解説をします。
授業時間外の学習（準備学習・復習・宿題等）Work to be done outside of class (preparation, etc.)
起案を行う授業前の予習としては、当該文書に関する手続法の基本書の該当部分を読みます。ただし、内容証明郵便の起案及び公正証書の案の起案の前は、法的に内容証明郵便が問題となってくる場面、法的に公正証書が問題となってくる場面を、条文を検索したり、基本書の索引から検索したりして、確認をします。
起案を行った後解説の授業の前は、起案で問題となった実体法上の部分について、法律要件・法律効果を基本書で確かめた上で、問題となった事案と照らし合わせながらどのような当てはめが可能だったのかを、改めて考えます。
解説の授業後は、レジュメを参考にしながら、該当部分の基本書を再度よく読み、授業内容が基本書の内容とどの様に関係してくるのかを、よく復習します。
以上を通じて、基本書レベルでの法律用家・法律効果の重要性を確認していきます。
本授業の準備学習・復習時間は各2時間を標準とします。

教科書は使用せず，レジュメ等の資料を配布します。

特にありません。
起案すべき法律文書については、資料として見本をお配りします。
成績評価の方法と基準Grading criteria
平常点で評価します。
その際に参考とするのは、６回の授業内起案と授業での質疑応答で、起案を９０％、質疑応答を１０％の割合で評価します。
各起案は，Ａ（優），Ｂ（良），Ｃ（可），Ｄ（不可）で採点します。
なお、起案日に授業を欠席した場合は、Ｄ評価とします。
学生の意見等からの気づきChanges following student comments
基本的には，前年の法律文書作成の講義を敷衍しますが，これまでの様子からして，民事保全については学生の知識不足がありそうなので，民事保全の起案をする前に，１回の講義時間を使って，概括的な民事保全の解説を行うこととします。

起案日は，大学が用意している答案用紙をご用意ください。
起案日にお配りした資料は，翌週の授業に必ず持参してください。
