Outline (in English)
・Course outline
This course deals with the rules and problems about the legal relations, when someone is done for others interests on no duty, interests are yielded on no legal grounds and the rigths are infringed.
And by learning about the cases that have relations to the problems stated previously, students aim to acquire how to apply each of these articles, practically.
・Learning Objectives
By the end of the course, students will be expected to be able to do the following:
①to understand what case is judged to be tort and if the case is judged tort, what effects come up.
②to understand what case is judged to be negotiorum gestio and if the case is judged negotiorum gestio, what effects come up.
③to understand what case is judged to be unjust enrichment and if the case is judged unjust enrichment, what effects come up.
④to apply each article that learn at this course to practical case, taking ①～③ into consideration.
・Learning activities outside of classroom
Before each class meetings, students will be expected to have read the articles that took up at next class meetings.
After each class meetings, students will be expected to take the time to read the relevant part of the text, referring to the explanation and the papers about summary that provided at each class meetings.
Your required study time is at least four hours for each class meetings.
・Grading Criteria
Final grade will be decided based on Term-end examination(100%).

授業の概要と目的（何を学ぶか）Outline and objectives
「民法第三編債権第三章事務管理、第四章不当利得、第五章不法行為」の規定に関わる諸問題について学ぶ。
関連する判例等についてもあわせて学習をすることで、各規定が実際にどのような場面において、どのようなかたちで適用されているかを理解する。

②特殊不法行為の要件・効果等を理解する。
③事務管理の要件・効果等を理解する。
④不当利得の要件・効果等を理解する。
⑤①～④をもとに、具体的な検討ができる。
