Outline (in English)

This course introduces students to the basic concepts of contract law and tort law so as to enable them to deal effectively with the disputes related to contracts and torts. The principles of contract law are mostly provided in Chapter 2, Part.3 of the Japanese Civil Code, and those of tort law in Chapter 5. The course will also address the basic principles of unjust enrichment and negotiorum gestio under Chapter 3 and 4 of the Civil Code.
Upon completion of this course, students should have a clearer sense of how the law operates and how lawyers (courts) help to shape it in civil law practice, enhance reasoning skills in relation to complex legal problems and develop the ability to identify major contract and tort issues which may arise in a particular factual situation.
