Outline (in English)

This course addresses laws of property and security interests, the principles of which are provided in Chapter 2 of the Japanese Civil Code. Property law introduces students to the basic forms of establishing entitlements, the rules on transfer of ownership in general, conveyancing and private control of land use. Security interest refers to the property rights of a creditor whose right to collect a debt is secured by property (‘collateral’) and this course covers the rules on several types of security interests: mortgages, charges, pledges and liens.
Upon completion of this course, students should have a clearer sense of how the law operates and how lawyers (courts) help to shape it in civil law practice, enhance reasoning skills in relation to complex legal problems and develop the ability to identify major property-related issues which may arise in a particular factual situation.
